These Terms of Service ("Terms") govern your access to and use of the FRACP MCQ mobile application and the website at https://fracpmcq.com (together, the "Service"). The Service is operated by FRACP MCQ ("we", "us", "our", or "FRACP MCQ").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. Eligibility

The Service is designed for medical students, trainees, and practitioners preparing for the Royal Australasian College of Physicians (RACP) written examinations. You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this requirement.

2. Accounts and Approval

• Accounts are created by invitation or registration and require administrator approval before access is granted.
• You must provide accurate and complete information when registering.
• You are responsible for safeguarding your account credentials and for all activity under your account.
• We may suspend or terminate accounts that breach these Terms or that we reasonably believe are being used improperly.

3. Educational Use Only

The Service generates and delivers practice questions, study notes, flashcards, and analytics for educational revision purposes only. The content is generated with the assistance of artificial intelligence and reviewed through automated and human processes, but it may contain errors or become outdated. The Service is not a substitute for professional clinical judgment, medical advice, or local hospital guidelines. Always consult current clinical guidelines, approved prescribing references (such as the PBS and TGA), and qualified medical professionals before making clinical decisions.

4. User-Generated Content

You may submit feedback, flag questions, contribute community questions, write notes, and participate in peer review. You retain ownership of content you submit, and grant FRACP MCQ a non-exclusive, royalty-free licence to host, display, reproduce, and use that content to operate and improve the Service. You must not submit content that is unlawful, infringing, defamatory, or otherwise prohibited by the Acceptable Use section below.

5. Acceptable Use

You agree not to:

• Misuse the Service to generate, store, or distribute harmful, offensive, or unlawful content;
• Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service, its data, or other users' data;
• Scrape, harvest, or resell Service content without our written consent;
• Use the Service for any commercial purpose without our written permission;
• Introduce viruses, malware, or any malicious code;
• Violate any applicable Australian or international law.

6. Intellectual Property

The Service name, branding, software, and generated educational content (excluding user-submitted content) are owned by FRACP MCQ Pty Ltd and are protected by Australian and international intellectual property laws. "RACP" and "FRACP" refer to the Royal Australasian College of Physicians; FRACP MCQ is not affiliated with, endorsed by, or sponsored by the RACP, and no RACP examination content is reproduced.

7. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, reliability, fitness for a particular purpose, or that the Service will be uninterrupted or error-free. Medical knowledge changes frequently; you should independently verify any clinical information before relying on it.

8. Limitation of Liability

To the extent permitted by law, FRACP MCQ Pty Ltd and its officers, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Where the Australian Consumer Law applies and guarantees cannot be excluded, our liability is limited to resupplying the Service or paying the cost of resupply, at our option.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or for any operational reason. Upon termination, your right to use the Service ends, but these Terms continue to apply to your prior use.

10. Privacy

Our handling of personal information is described in our Privacy Policy, available at https://fracpmcq.com/privacy-policy. By using the Service, you consent to the practices described there.

11. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes through the Service or by other reasonable means. Continued use after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any dispute arising out of or relating to these Terms is subject to the exclusive jurisdiction of the courts of Queensland.
